Changes in Legislation - How do they Affect You?

The legal rights of employees have probably grown faster than any other area of law in the past few years, and are gradually being extended to many self-employed, agency and temporary workers too, under European Community Directives.

It may surprise you, but unfair dismissal claims are often decided mainly on whether the employer followed the recommended disciplinary and appeal procedures, not on whether the employee was actually guilty of misconduct. You may be equally surprised to learn that the law often requires employers facing discrimination claims to prove that they did not discriminate, in effect, to prove their innocence.

If you are an employer, it is not enough simply to treat everyone fairly and equally to avoid unfair dismissal and discrimination claims, although this is often a good starting point. We can advise employers, including those in small family businesses and farms, as well as larger companies, on how the changing legislation affects them. This will include suggesting practical changes (such as the preparation of good written disciplinary and grievance procedures), which will immediately and greatly reduce your risk of costly claims.
